ACCEPTANCE OF TERMS

These Terms and Conditions of Use and Sale ("Terms") govern your access to and use of Oshawa Security Systems' ("we," "us," or "our") website, services, and the purchase of our products (collectively, the "Services"). By accessing our website or purchasing our products, you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to modify these Terms at any time without prior notice. Your continued use after changes constitutes acceptance. The most current version is available on our website.

SERVICES AND LICENSE

Our website provides information about security systems and related resources. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. Any unauthorized use terminates this license.

SALE OF PRODUCTS AND SERVICES - NO RETURNS OR REFUNDS
THIS SECTION IS OF CRITICAL IMPORTANCE. PLEASE READ CAREFULLY BEFORE PURCHASING.

Custom Installation Services: Our security systems require professional installation. By purchasing our products, you acknowledge and agree that you are purchasing both the physical equipment and our professional installation service.

Payment Terms: Full payment is due upon completion of installation. We may require a deposit to schedule installation, which will be applied to the final balance.

NO RETURN OR REFUND POLICY: ALL SALES ARE FINAL.

Due to the custom nature of the installed security systems, which are configured and integrated specifically for your premises, we do not accept returns and do not offer refunds under any circumstances once installation has commenced or been completed. This includes, but is not limited to, change of mind, dissatisfaction with product performance where the product is not defective, or failure to secure necessary permissions for installation (e.g., landlord approval). You acknowledge that you have reviewed product specifications and suitability before purchase.

Limited Warranty: Hardware manufacturers may provide separate limited warranties covering defects in materials and workmanship. These warranties are provided by the manufacturer, not Oshawa Security Systems. Our workmanship on the installation itself may be covered by a separate limited warranty, details of which will be provided in your service agreement. THESE WARRANTIES ARE YOUR SOLE REMEDY FOR ANY ISSUES. ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.

DISCLAIMER OF LIABILITY AND INDEMNIFICATION
YOUR USE OF OUR SERVICES AND PRODUCTS IS AT YOUR SOLE RISK.

Services "As Is": The website and all information thereon are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. We disclaim all warranties, express or implied.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OSHAWA SECURITY SYSTEMS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM (I) THE USE, INABILITY TO USE, OR PERFORMANCE OF THE SERVICES OR PRODUCTS; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (III) ANY FAILURE OF THE SECURITY SYSTEM TO PREVENT INCIDENT, LOSS, OR DAMAGE; OR (IV) ANY OTHER MATTER RELATING TO THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Indemnification: You agree to defend, indemnify, and hold harmless Oshawa Security Systems from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Services or violation of these Terms.

USER CONDUCT AND INTELLECTUAL PROPERTY

You agree not to misuse the Services. All content on the website, including text, graphics, logos, and software, is our property or our licensors and is protected by copyright and other laws. You may not modify, copy, or distribute any content without our express written permission.

THIRD-PARTY LINKS AND USER SUBMISSIONS

Our website may contain links to third-party sites. We are not responsible for their content or practices. Any materials you submit to us (e.g., feedback) become our property, and you grant us a license to use them without compensation.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles. Any dispute shall be resolved through final and binding arbitration in Oshawa, Ontario, and you waive any right to a jury trial or to participate in a class-action lawsuit.
